Double standard and totally up to interpretation, why would one reg be overlooked and the other not. Could be beat in court, no explanation of the "act of fishing" that I know of but there is limits set "per lincensed fisherman". Would cost ya a day in court but would most likely beat it.
Called a couple of years back on a hunting issue when the Outdoor Digest came out. It has always been, until then, to shoot squirrels from a boat under power was illegal but that year it very plainly said you could in the digest. When I asked the question I was told it was illegal, I asked the officer on the phone if he had a new digest. He said yes and I ask him to read what I had read, he said "Hmmm, looks like you would have a good case in court".
Be on you Ps and Qs is all I know to do, when in doubt dont do it.
