    I would take this up with e-bay as if you can prove the seller mis led you on his product. I WOULD CONTACT THEM AND SEE WHAT THEY SAY. There is a place for this in customer service

    Small claims I think is up to 5K ? Present your case, Get a judgement and have it attached to the wise arse father/ son............. I am not an attorney..................but I hope a @#$%^ with an attitude like that ....... gets his own.

    Well, I did learn one major lesson...never pay outside ebay again, and refuse to purchase without a test run.

    I live my life as right is right, wrong is wrong. God will handle what ever happens and I'll most likely dust off my britches and move on. If I'm lucky, I'll be able to recoup the down money I sent through ebay. Small claims is still an option that I will look at as soon as I have time. Am not sure how it would work across States and long distance. Since the amount is so small, it just doesn't warrant an Attorney. I was only wanting to hear any options available as far as Florida Law is concerned.

    Regardless, everything will be just fine.

    Heck, maybe I should submit this case to Judge Judy?

    Definitely not an attorney, but I can't imagine there is much you can do. It sounds as if you found out about the wrong year of the boat and the issues with the damaged hull prior to completing the transaction. As for the motor issues, I guess that's why people always say to make sure you take it for a test run first, don't take anyones word on it, and don't trust just running them on the muffs. Hindsight is 20/20, but if I was driving that far for a boat, I would probably ask the seller to take it to a local shop (at my expense) and have them look at it first. It's a shame that someone would try to pull one over on you, but it seems that a little more digging on the front end may have saved you some time and expense. Sorry about your bad experience.

    Crappie Reaper I am not an attorney but I do know you would have to file in small claims court in the county you did the transaction (Brevard). If you win it is still only a civil judgement against the defendant. You are probably better off spending the money on fixing themotor.

    Crappie Reaper Working in Law Enforcement even though you have the text every conversation that you guys had was not recorded, therefore it would be your word against his and he can say that he told you the boat was for sale as is. The fact that you took the boat even though you saw some discrepencies and they took some money off would look as if you were satisfied with the boat. Like you say if any wrong was done. vengeance is mine sait the Lord and he will repay it. Be Blessed and good luck
