DP you are right. Hard times on personal side of life sometimes causes us to have a bad day at work.
I feel like he will do the right thing. Make it right.
It's sad when something like this happens. It's also sad when everybody wants to throw the first stone. Even when it doesn't evolve them.
We fish on one of the world's greatest Walleye lakes world famous(because Our ARK Game and fish have worked to make it this way)(long unthankful hours).We get asked by a local Boat Dock to take some of their guest fishing.One guest wanted us to take him out to catch a walleye.We don't target Walleye but we catch a few crappie and bass fishing some nice ones!!(trophy They are mounted at the country store in Drasco.We took this guest out fishing he was to pay us $250.00 was the agreed on price.Our lake has a slot limit on walleye.The upper limit is a trophy Walleye on any other lake.This guest catches one that is just is in between the slot but close to the upper limit.Hes says this is a trophy I want to keep it and have it mounted.WHAT WOULD YOU DO AS A GUIDE? Its illegal in the slot if we get caught with this fish by Mr greens jeans ( friends we fish with) We are in trouble) We told him he had to release the trophy walleye(He got fighting mad) the biggest walleye he had ever caught and would ever catch. By law we had to release the fish unharmed(He had a trophy)We refunded his Money) He had spent lots of money driving to our lake and motel rooms,gas expensive).Guiding for money you can get in some trouble real fast.Its a harder game than you think. You need to get your money back for sure and also need to help this guy also a( win win for everybody!!!)
I've received communication from the guide telling me that he's seen the thread and that he was battling some severe blood sugar issues that weren't allowing him to think clearly. Whether or not he's being honest, I have no idea, but I'm going to give him the benefit of the doubt and not put his name on this thread unless I don't receive my check that he claims is in the mail. As for those of you saying that I need to visit with a lawyer in regards to a potential slander lawsuit, I'd be glad to meet the guy in court if that's what he feels is in his best interest. I'm not saying I'm a lawyer, but I've got permanent documentation showing that he wasn't thinking clearly when these events took place, so he'd be hard pressed to have much of anything to stand on. The way I presented the material in the initial post is exactly what took place and in the order it took place. That doesn't quite meet the definition of slander. To those of you that have sent me PM's and know who it is, I ask that you not put it on here. Also, thanks to those of you who sent me PM's offering their services.
I'm glad you got it worked out. I sure hate that you drove all the way down here to have that happen. If you ever get back down post a note on the board and I'm sure some of the good folks on here will make sure you have a better trip.
This is a legal issue. Once you get "labeled" as a violator with AGFC, that's a hard reputation to overcome. This matter is a no-brainer for me. Keeping a fish "out of slot", keeping 5 or 6+ fish overlimit, shooting a duck or two over limit is easy to do, until you get caught. Then, the price you pay ain't worth the trouble it causes.
Always best to reach an amicable solution. I have to believe that this thread, and the possibility of disclosure played a part in it.
Having personal experience with slander issues, I will tell you that truth is the absolute defense to slander. As long as you tell the truth, there is no action that will overcome the truth.
