But Thomason says another Mississippi firm stole his intellectual property and is confusing customers by using similar marketing materials.
The CEO of Pearl, Mississippi-based Millennium Outdoors said Monday that he had not yet seen the lawsuit and declined comment. The company does business as Millennium Marine, and sells its “Sidekick Fishing Double Seat" on Amazon and through Walmart, Ebay and large outdoor retailers Bass Pro Shop and Cabela's.
The dispute between the two Mississippi firms began in 2016, when Thomason applied for a patent and began discussing a possible partnership with Millennium to sell the product

But after Millennium developed prototypes in China, Thomason told the company that he had concerns about their quality and would not move ahead with a partnership if the product didn't meet safety standards, the lawsuit states.
Belmont, Mississippi-based Dub-L-Seat is requesting a jury trial and wants a judge to order Millennium to quit using certain marketing materials. It's also seeking what it considers to be lost sales, claiming that Millennium wrongly took its intellectual property and profited from its concept.

I have seen a guy get the threat of a lawsuit on something as simple as jig making name on a ma and pa shop by a pro athlete,
all the way up to Shakespeare on the name Ugly stick they took from a guy in Texas , he prevailed and they bought the name from him back when for an undisclosed amount of change .
heck even the word KABOOM is trademarked these days :Rofl
I just thought it was odd since I’m getting ready to order one next week.
I was researching double seating on the ole inter web and a couple articles of this nature came up.
Tried to just forward the article but that didn’t work for me.

I have friends that have the Dub L Seat and friends that have the Millineum Side Kick. There is no comparison....they are two totally different designs. The Millineum Side Kick in my opinion is a better design.

Ask Mark about his dealings with the guy. And he actually bought the name and design from a member here that never posts any more. He actually built and sold the double seat years ago and the name Dub-L-Seat was coined by him. It was named after his dad. Granted he did make improvements to it and did finally get a patent. It’s going to be interesting before it’s over I’m sure.Quote:

How can there be an issue if the design wasn't patented but even yet they are nowhere near the same design?
I know the story and could comment a whole lot more but won't. I will say this, I was in the process of buying from the ORIGINAL designer mentioned earlier (how I know Cumberland had one also) when it was taken over from the second individual, I purchased one from him....never was right directly from the box and promises or warranties were never honored. I ended up giving it away because I got tired of all excuses and headaches of trying to deal with him!
Looks like to me, until a patent is issued it is open market and even at that if the sign is different how can the issue be pressed? I am no lawyer tho :)
