In MS. they can and do depending on the situation
In IN...DNR can and does give breathalyzer tests to drivers of boats,,normal arrest is .08 for driving anything,,but in a boat..they can arrest for .05 for the test. And,,driver cannot have open container in boat. They an also arrest fo PI to riders in boat.
Not sure but I know they can hold you there while they call water patrol and they can and will write a ticket or arrest ya.
It is illegal to operate a boat under the influence, surely, but illegal to drink a beer? I don't think so.....but let's see what kind of answer you get. May be an eye-opening response for some of us
With the size of party cove at LOZ and the two mini party coves at Truman I don't believe it is illegal to drink while out in the boat in Missouri. Otherwise there would be a lot of tickets getting written on weekends on Truman. I do know water patrol can write tickets for DUI as I use to work with a guy that received one.
as long as your not the driver who is drinking, don't drink and drive a boat.
I think in ks the agents can do it all just like a sheriff or hipatrol??>
I was listening to the missouri outback show(on the internet) its the guys from bucksaw, Richard bowing, everharts. etc this last week , they had water patrol on and im 99% sure he said you can have open container, just not be under influence (blow.08) or more. listen to it. lots of good info on there.

may 22 show, oabout 1/2 way through segment 2. according to the officer, you can drink and drive a boat, just don't get to .08..then its full on DUI...

Thanks for the information. I like to drink a beer after dinner and didn't know If I could get in trouble. Got pulled over and they check the livewell and measured the fish but didn't say anything about the open beer container.
If they are armed, they can probably arrest you.
Different bodies of water have different regulations but a DUI is a DUI and it applies to water and land and not just public HWYS, A friend got a DUI driving his ATV through his hayfield. Never got the the whole story but he was in a fenced area admittedly it is 150 acres but it is all fenced, He did got get a fine but Judge gave him a warning and had to pay court costs.
Some of our local lakes are alcohol prohibited and some aren't.
