    Default scenario: legal or not?


    say a fella goes to sardis RESERVOIR and catches his 15(or maybe just 10) fish and leaves. after getting home he decides to go back to the LOWER LAKE and fish some more. he catches another 15(or 20) fish. legal or not? just something that popped into my head today. maybe been discussed before. the limit for neither body of water has been exceeded nor the state limit of 30. aside from the point of having to keep the fish separate and proving what came from where, if the need arose, whats the opinions? seems legal to me.

    Just a opinion, I would say if you got checked on upper with 15 went home came back and had more than 5 on lower and got checked by same guy you could be guilty of being over on Sardis lower limit for the day. State limit does not matter in a case like this. Lots of things would have to align against you but it could happen.

    most likely would get thrown out if you fought a ticket . I base this on a ticket given at Enid for two guys that went to Grenada and caught 10 fish under 10 inches . came to long branch on Enid . warden wrote them for short fish on Enid . (this was when you could have 5 per person any size on Grenada) as long as you were under the state limit you would "probably "get off .The judge said "laws/regulations must be clear to enforce . kind of like the digest saying release all fish under 10 inches had to be released immediately (several yrs. . back)and ramps at Enid had yellow signs (mdwfp) that said to release all fish that were 10 inches and under . question was "are ten inch fish legal on Enid(at that time?)Again it was not clearly written . fyi the digest was wrong and is not a legal document in court , but it saved a few locals for sure . Do what you feel is right because m.d.w.f.p don't have the man power to regulate thousands and we should protect our lakes .Not a question of is it legal but is it right . We all will reap the outcome of everybody's decision .

    You could catch limit after limit and take them home, but as long as you do not get caught, no problem! but switching from upper to lower, I still think it is a daily limit, not per lake per day. If its worth driving home then driving back to the lower lake for 5 more fish, I don't see how its illegal, but not very feasible for me.

    Believe Mo is correct. It is a state daily limit not a lake daily limit.

    Ok. If I am understanding the jigflinger correctly, your opinion is if you choose to fish Sardis reservoir and catch 15 fish, which is the limit for that area, then you are not allowed to keep fish from any other body of water the rest of the day in the state. ?? Is this what you are saying.?

    I would think as long as you don't go over the statewide limit it would be legal.

    No sir, that isn't what I am saying or inferring. It is simple. In my opinion if you catch 15 in Sardis proper, that is the lake limit. If one was to go to another body of water that has a 30 fish limit, you should be allowed to catch 15 to complete the State limit. Not 15 from Sardis and 20 from Enid or Grenada. State limits are aggregate. Used Enid and Grenada as examples. I know that some lake limits are higher. In which case it would still be the aggregate for all lakes for the State daily limit.

    The answer to the question is NO. Limit on lower lake is 20. Using the figures given it would be over the legal daily limit.

    i think you are saying what i was saying in my original post. if i caught 15 on sardis reservoir and then went to the lower lake, or enid, grenada or butla, i could keep another 15. or even 35 at tunica, where the limit is 50. " the limit for neither body of water has been exceeded nor the state limit of 30. "
