Actuall, the LFT website says 'patent pending', which means they have applied for a patent but have not necessarily been granted one. If you're serious about this bait, look into their patent and read it to see exactly what they're seeking protection on. I find it hard to believe that noone has ever done similar 'slots' before, and if it has been done before then their patent (even if granted) would not hold up in court. My 2 cents.
There's a big difference between the lake fork slots and this bait. There's already several baits out there using a series of balls on a rounded shank with a single ball on the end. This is slightly different, but doesn't look anything like the flat slots that Lake Fork uses in their swim baits. I wouldn't worry. At worst, they'll send you a letter asking you to stop, before they do anything else.
As to the bait, Jeep's question of how long matters. Also, the softness of the plastic will really affect the action. If it's soft enough, it'll have action, and if it's retreived like a swimbait, the ball will add to the action as the water moves past it.
I'd like to try it and see.

you would be surprised at what is granted. Its easy to sit back and say go for it, but its different when its your money on the line. They will get the patent, doesnt matter if others have used it in the past if they didnt protect it. Its all boils down to who has the deeper pockets.LFT has the legal staff to do it and the money to back it. Even if they are wrong could you pay the 20-100,000 legal bills to fight it even if you win its years in court and not worth it in the end. I am not telling him not to do it but only saying he better check in to it before investing money thats hard enough to come by these days only to be shut down with out anything to show for it. FYI blakemore didnt invent the road runner but they were the first to protect the design so the own it now.
